1. Acceptance of these terms
By accessing or using this website (mgbaccounting.co.za, the “site”) you agree to these Terms of Use. If you do not agree, please do not use the site. We may change these terms from time to time by updating this page; the date at the top shows when they were last revised, and your continued use of the site after a change means you accept the revised terms.
2. About us
The site is operated by MGB Accounting and Tax Services Inc. (“MGB Accounting”, “we”, “us”), a South African accounting and tax practice based in Roodepoort, Gauteng and Rustenburg, North West. Our professional staff are members of the South African Institute of Chartered Accountants (SAICA) and registered tax practitioners with the South African Revenue Service (SARS), and we are bound by those bodies’ codes of conduct. Company registration and practitioner details are available on request. The information in this section is provided in terms of section 43 of the Electronic Communications and Transactions Act 25 of 2002.
3. Information on this site is not advice
The content of this site — including descriptions of our services, tax and compliance information, articles and figures — is general information only. It is not accounting, tax, legal or financial advice, it does not take your particular circumstances into account, and it should not be relied on as a substitute for advice from a suitably qualified professional who knows your situation. Tax law and SARS practice change frequently; while we try to keep the site accurate and current, we give no warranty that any content is complete, accurate or up to date.
Using this site, or sending us an enquiry or quote request, does not create a client relationship between you and MGB Accounting. A client relationship is created only when both parties have signed an engagement letter.
4. Quote requests and engagements
- A quote request submitted through the site is a request for a proposal. The acknowledgement email you receive confirms only that we have received your request.
- Any quote we send you is an invitation to engage us on the terms set out in the quote and our engagement letter. It is not a binding offer, and we may decline an engagement at our discretion — including where professional independence, conflict-of-interest or client-acceptance requirements are not met.
- Quotes are based on the information and documents you provide. If they are inaccurate or incomplete, the quoted fee and scope may change.
- Unless a quote says otherwise, it remains valid for 30 days from its date.
- Any services we perform are governed by the engagement letter, which takes precedence over these terms.
5. Information you provide
You are responsible for the information and documents you submit through the site. You warrant that:
- the information you give us is true, accurate and complete to the best of your knowledge;
- you are entitled to provide the documents you upload — including any personal information about other people contained in them (for example directors, employees, customers or suppliers) — for the purpose of obtaining a quote and, if you engage us, receiving our services;
- uploaded files are free of viruses and other harmful code; and
- you will upload only the documents we ask for and will not send us information we do not need.
Uploads are limited by type and size as indicated on the form. We may delete submissions that fall outside those limits, that appear to be spam or automated, or that contain harmful code.
6. Acceptable use
You may use the site only for lawful purposes. You must not:
- submit false, misleading or fraudulent information, or impersonate any person or business;
- use automated tools to submit forms, scrape content or probe the site;
- attempt to gain unauthorised access to the site, its hosting infrastructure or any related system;
- introduce viruses, malware or other harmful code; or
- use the site in a way that damages, disables or impairs it or interferes with anyone else’s use of it.
7. Intellectual property
The site and its content — including text, layout, graphics, logos and the MGB Accounting name and brand — are owned by or licensed to MGB Accounting and are protected by South African and international intellectual-property law. You may view, download and print pages for your own personal or internal business use. You may not otherwise reproduce, distribute, modify or commercially exploit any content without our prior written permission. Third-party names and logos (for example SAICA, SARS, Sage, QuickBooks and Xero) belong to their respective owners.
8. Third-party links and services
The site may contain links to third-party websites, such as SARS, the CIPC, software providers and our social media pages. These are provided for convenience; we do not control and are not responsible for their content, availability or privacy practices, and a link does not imply endorsement.
9. Availability of the site
We aim to keep the site available at all times but do not guarantee uninterrupted or error-free access. We may suspend, withdraw or change any part of the site without notice, including the quote request facility. If the quote form is unavailable, you are welcome to contact us by email or telephone instead.
10. Disclaimers and limitation of liability
The site is provided “as is” and “as available”. To the fullest extent permitted by law, we exclude all warranties, express or implied, regarding the site and its content, and we will not be liable for any loss or damage — direct, indirect, consequential or otherwise — arising from your use of, or inability to use, the site or from reliance on any content on it.
Nothing in these terms excludes or limits liability that cannot be excluded or limited under South African law, including your rights under the Consumer Protection Act 68 of 2008 where it applies, or our liability for services performed under an engagement letter, which is governed by that letter.
You agree to indemnify MGB Accounting against any claim, loss or expense arising from your breach of these terms or from information or documents you submit through the site.
11. Privacy
Personal information submitted through the site is processed in accordance with our Privacy Policy, which forms part of these terms. It explains what we collect, why, how long we keep it and your rights under the Protection of Personal Information Act.
12. General
These terms are governed by the laws of the Republic of South Africa, and you consent to the jurisdiction of the South African courts. If any provision is found to be unenforceable, the remaining provisions continue to apply. Our failure to enforce a provision is not a waiver of it. These terms, together with the Privacy Policy, are the entire agreement between you and MGB Accounting regarding your use of the site; any services we provide are governed separately by the applicable engagement letter.
